- The amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.
This electronic record is generated by a computer system and does not require any physical or digital signatures.
The brand “Sajaao” and this website is owned, registered and operated by Swadeo Design Private Limited ("Company"), a private limited company, incorporated under the provisions of the Companies Act, 2013 and having its registered office at 401, Ayaan Apartments, Lane 06, Veerbhadra Nagar, Baner, Pune – 411 045.
These terms of usage (“Terms of Use”) govern your use of the Website and Services (as defined below) provided through the Website. By using or visiting the Website, or by using any content or information provided as part of the Website/Services, You shall be deemed to have read, understood and accepted to be bound by these Terms of Use.
For the purpose of these Terms of Use, wherever the context so requires "You", “Your” or “Customer” or “User” shall mean any natural or legal person who uses the Website for availing the Products and Services. The term “We”, “Us”, “Our” shall mean the Company, its employees, and authorised agents that perform any services on the Company’s behalf.
2. Acceptance of Terms:
By using our Site or services, you confirm that you are at least 18 years old or using the Site under the supervision of a parent or legal guardian. If you do not agree with these Terms, please do not use our Site.
3. Use of the Site:
You agree to use the Site for lawful purposes only. You must not use the Site in any way that may cause harm to the Company, impair the functionality of the Site, or infringe upon the rights of others.
4. Representations, Warranties and Obligations of the Website:
We hereby represent and warrant that
- We are a duly registered private company under the relevant provisions of the Companies Act 2013;
- We are in compliance with the applicable law to provide services, subject to these Terms of Use;
- We will comply with the Privacy Policy and ensure the data security of the Users at all times;
5. Representations, Warranties and Obligations of the Customer:
The Customer hereby represents and warrants that
- You are a natural or legal person, competent to contract, and have read, understood and agreed to be bound by these Terms of Use;
- They shall provide accurate information and details at the time of registration.
- They shall not default in making payments for Products bought from the Company through the Website;
- They agree and acknowledge that minor variations in colour, shades, texture, or overall appearance may exist between the Product image displayed on the Website and the actual Product received, as artworks are inherently subject to such variations due to the nature of digital display limitations.
- They shall not demand for refund/ replacement of the Product for such minor variations as mentioned above in point.
- They agree and acknowledge that once the order has been placed on the Website for a Product, they shall not be allowed to modify or cancel the order.
6. Account Registration:
To access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for maintaining the confidentiality of your account, One Time Password (OTP).
7. Product Information and Orders:
Artwork Availability: Premium artworks displayed under the ‘Premium Art’ Section on our website are subject to inquiry. In case of availability, we will notify you about the further process for processing the order.
Customization: Custom or personalized orders (e.g., custom frames) may require additional processing time and are non-refundable.
Pricing: Prices are listed in INR (Indian Rupees) and are subject to change without notice. Any applicable taxes and shipping fees will be calculated at checkout.
8. Shipping and Delivery:
Shipping Timelines: We aim to deliver within the estimated timeframe mentioned at checkout. However, delivery times may vary due to unforeseen delays.
International Shipping: Customs duties and taxes for international orders are the responsibility of the customer.
Damage or Lost Shipments: If your order arrives damaged or is lost in transit, please contact us within 48 hours of the estimated delivery time. For more details, refer to our Shipping Policy.
9. Returns and Refunds:
Returns shall be accepted only in cases where the Product/Artwork is received in a damaged condition. To initiate a return, the Customer must provide a clear and continuous unboxing video of the Product/Artwork taken at the time of opening the package. This video must clearly show the original sealed packaging, the process of unboxing, and the damage or defect in question.
In the absence of such an unboxing video, the Company reserves the right to reject the return request. All return requests must be made within 48 hours from the time of delivery. Refunds, if approved, shall be processed to the original payment method. Shipping fees are non-refundable. See our Refund Policy for further details.
10. Privacy:
We value your privacy. Our collection and use of personal information are governed by our Privacy Policy. By using our Site, you consent to the collection, use, and sharing of your information as outlined therein.
11. Intellectual Property:
All content on the Site, including text, images (photos of the paintings/artwork), logos, and graphics, is the property of the Company or its content suppliers and is protected by applicable copyright and trademark laws. You may not use or reproduce any content without our prior written consent. Such use is strictly prohibited.
Upon full payment and successful purchase of any painting or artwork through our platform, all rights, title, and interest in the purchased artwork shall transfer to the customer. The customer shall thereafter hold complete ownership of the physical artwork and may use, display, or resell it at their sole discretion. However, unless otherwise explicitly agreed in writing, the artist retains the copyright and moral rights to the artwork, including the right to distribute and publicly display images of the work for promotional or portfolio purposes.
12. Limitation of Liability:
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of our products.
13. Third-Party Services:
We may use third-party service providers to help operate our business and the website. These providers have agreed to maintain the confidentiality of your information and only use it for the purposes we specify.
We are not liable for delays, loss, or damages caused by third-party shipping providers.
14. Modifications to Terms:
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
15. Termination:
We may terminate or suspend your access to the Site without notice if you violate these Terms or engage in any unlawful or harmful activity.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Pune.
